2. SUBJECT

This Distance Sales Agreement regulates the rights and obligations of the parties in accordance with the provisions of the Consumer Protection Law No. 6502 and the Distance Contracts Regulation, regarding the sale and delivery of the service with the specifications and sales conditions stated in the agreement, where the BUYER orders photography services and/or related products (digital photographs, physical prints, etc.) electronically through the website www.istanbulportrait.com owned by the SELLER.

3. INFORMATION ABOUT THE SERVICE/PRODUCT SUBJECT TO THE AGREEMENT

The type, quantity, features, and sales price including taxes of the photography service and/or product are detailed in the content of the package/product selected by the BUYER on the website.

4. GENERAL PROVISIONS

  1. The BUYER acknowledges that they have information about the essential characteristics of the service/product subject to the agreement, the sales price, payment method, and delivery and return conditions on the website www.istanbulportrait.com, that they have read this preliminary information, and have given the necessary confirmation electronically.
  2. The service/product subject to the agreement shall be delivered to the BUYER or the person/organization at the address indicated within the period explained in the preliminary information on the website for each service/product, depending on the distance of the BUYER's place of residence, provided that it does not exceed the legal 30-day period.
  3. If the service/product subject to the agreement is to be delivered to a person/organization other than the BUYER, the SELLER cannot be held responsible for the receiving person/organization's refusal to accept delivery.
  4. The SELLER is responsible for delivering the service/product subject to the agreement intact, complete, and in accordance with the specifications stated in the order.
  5. For the delivery of the service/product subject to the agreement, it is required that this agreement be approved electronically and the sale price be paid with the payment method preferred by the BUYER. If for any reason the service/product price is not paid or is canceled in bank records, the SELLER is deemed to be released from the obligation to deliver the service/product.

5. RIGHT OF WITHDRAWAL

The BUYER may exercise the right of withdrawal within 14 (fourteen) days from the date of delivery for product sales transactions, and from the date the agreement was signed for service sales transactions, without assuming any legal or criminal liability and without showing any reason.

However, the right of withdrawal cannot be exercised in the following situations:

  1. Digital products and photographs customized in accordance with the BUYER's special requests
  2. Photography services reserved for a specific date or period (can be canceled up to 72 hours before the reservation date)
  3. Photographs and digital content that are delivered instantly in digital format and have been downloaded by the BUYER
  4. Physical print products whose packaging has been opened by the BUYER

It is mandatory to notify the SELLER in writing within the 14 (fourteen) day period to exercise the right of withdrawal. In case of exercising the right of withdrawal, a copy of the cargo delivery receipt showing that the service/product delivered to a third party or to the BUYER has been sent to the SELLER must be returned.

The cargo fee for the product returned within the scope of the right of withdrawal is covered by the BUYER. If there is a decrease in the value of the product due to a reason arising from the BUYER's fault or if return becomes impossible, the BUYER is obligated to compensate the SELLER's loss in proportion to their fault.

In case of exercising the right of withdrawal, it is mandatory to return a copy of the cargo delivery receipt showing that the product delivered to a third party or to the BUYER has been sent to the SELLER, along with the original invoice.

The product price is refunded to the BUYER within 14 (fourteen) days following the exercise of the right of withdrawal. If the original invoice is not sent, VAT and other legal obligations, if any, are not refunded.

6. PAYMENT AND DELIVERY

In case of ordering by Bank Transfer or EFT (Electronic Fund Transfer), ATM Card, Credit Card, or online payment, after the entire payment related to the order placed by the BUYER is collected, service provision begins and products are shipped in accordance with the terms of the agreement.

For digital content deliveries, a download link is sent to the email address specified by the BUYER after payment approval, or access is provided through their personal account.

Physical print products are sent to the delivery address via a courier company. Delivery time may vary depending on the product preparation time and the working conditions of the courier company.

For photography services, the reservation is completed after payment approval, and the service is provided on the selected date and time.

7. PRIVACY AND PROTECTION OF PERSONAL DATA

The SELLER has taken all necessary technical and administrative measures to protect the BUYER's personal data. The BUYER's personal data are processed and protected within the scope of the Personal Data Protection Law No. 6698.

The SELLER does not share the BUYER's personal information, photographs, and other content with third parties without the BUYER's explicit consent. However, the SELLER acknowledges that it is obligated to respond to requests from authorized administrative and judicial authorities within the scope of legal obligations.

8. COMPETENT COURT

In the implementation of this agreement, Consumer Arbitration Committees up to the value announced by the Ministry of Trade, and Istanbul Consumer Courts and Enforcement Offices for transactions above this value, are authorized. The BUYER accepts, declares, and undertakes that in disputes that may arise from this agreement, the SELLER's official books and commercial records, electronic information kept in its database and servers, and computer records will constitute binding, definitive, and exclusive evidence, and that this article constitutes an evidence agreement within the meaning of Article 193 of the Code of Civil Procedure.

9. ENTRY INTO FORCE

This agreement, consisting of 9 (nine) articles, enters into force on the date it is approved electronically by the BUYER and is deemed to have been executed by the BUYER's approval.
